Contents: CLAB (from 'Clauses Abusives') Europa is a database of case law about unfair contractual terms in consumer contracts in the European Economic Area (EEA) countries. The researcher uses a "creation of request" window to formulate a search query based on 20 different criteria to locate the text of similar cases in the database. The search criteria are largely based on Directive 93/13 EEC of 5 April 1993 (and its annex) concerning unfair terms in contracts. Although the database provides information on various national legal systems, it uses a common "CLAB" approach to defining terms and concepts; these terms are defined online to assist users from various jurisdictions. This database should be of use to attorneys and researchers in the field of European consumer contracts. |
